Santa Clara County Civil Court Records

Restricted records

Not every criminal document is public

The court identifies victim-identifying arrest materials, probation reports, domestic-violence protective orders, O.R. reports, criminal-history information and certain financial or medical information as records the public cannot simply inspect or copy.

Once you have the criminal case number

Be specific about the document you want. The court gives examples such as a minute order from a particular date, docket, sentencing record or complaint. Include the full defendant name and other information requested by the clerk.

A criminal filing is not a conviction. Read later docket events and the disposition before describing what happened in a case.

Family Court Records Have Different Remote-Access Rules

Santa Clara Family Court handles divorce, legal separation, nullity, parentage, custody, visitation and support matters. Some family case information can be found through the Case Information Portal, but California Rule of Court 2.503 restricts remote public access to the underlying electronic records in Family Code proceedings.

Prepare these details before asking for a copy

  • Complete case number.
  • Full names of the parties.
  • Exact document title.

  • Number of copies needed.

The court says mail-request checks should be payable to the Superior Court. If the exact charge is unknown, its current case-information instructions allow a check marked “Not to exceed” a specified amount.

Ask before buying certification. An ordinary court printout or photographed public record is not automatically a certified copy. Ask the organization receiving the document what form of authentication it requires.

New courthouse copying option effective January 1, 2026

California law now allows a person who is entitled to view an electronic court record in the courthouse to use a personal camera or cell-phone camera to photograph that record as a method of copying it. Santa Clara Superior Court states that this applies to permitted paper records and public-access terminal displays.

The rule does not authorize photography of confidential, sealed or restricted records, and it does not override restrictions on cameras in courtrooms or secure court areas.

Older Santa Clara Court Records May Require Clerk Research

The strongest local date distinction applies to criminal records. Cases filed in 2004 or later can be searched through the current criminal index; older criminal cases require a clerk name search under the court’s current instructions.

Older civil, family and probate files can also be unavailable as remote document images even when an index entry exists. California Courts advises that older records may be stored away from the courthouse and can take longer to retrieve.

California Rule 2.503 Explains Why Some Records Are Courthouse-Only

California Rule of Court 2.503 requires public electronic records to be reasonably available in some form unless sealed or confidential, but it also distinguishes remote internet access from electronic access at the courthouse.

For records in family, juvenile, guardianship, conservatorship, mental-health, criminal and several protective-order proceedings, the rule generally allows courthouse electronic access while restricting public remote access to the underlying records. Calendars, indexes and registers of actions have separate electronic-access rules.
