Three Courts at Law

Case assignments matter

Smith County’s three County Courts at Law handle misdemeanor criminal and civil matters. County Court at Law and County Court at Law 2 handle family matters, while County Court at Law 3 is the designated juvenile court and handles contested probate cases.

Probate indexes are online, but document images are not

The County Clerk Probate Division says indexes are available online, but probate document images are available only at the County Clerk’s office Monday through Friday from 8 a.m. to 5 p.m.

If you locate an estate, guardianship or probate case but need the will, application, order or another filing, contact the Probate Division instead of assuming the document should be downloadable.

Probate contact The Smith County directory lists the Probate Division at 903-590-4678. The official Probate page also directs users to the deputy clerks for document-copy requests.
Court records are not ordinary Public Information Act requests. Smith County’s Probate Division explains that judicial records are excluded from the ordinary Texas Public Information Act framework and are governed by Supreme Court rules or other applicable law.
