Why an old probate file will not appear in the modern search
The existence of records from 1846 does not mean every nineteenth- or twentieth-century probate file has been indexed in the current online system. The county provides a separate copy-request form specifically for probate records from 1846 through 1983.
Do not use a Public Information Act request for the probate file
The County Clerk expressly states that probate files and the probate index are judicial records and are not governed by the Texas Public Information Act. Use the clerk’s judicial-record search/copy process instead of a general county open-records request.
